Terms of Service

1) Acceptance of Terms

By accessing or using this website, creating an account, or purchasing products, you agree to these Terms of Service and all referenced policies (including our Privacy Policy and Legal Disclaimer).

If you do not agree, please do not use the Site or purchase products.

2) Accounts & Orders

• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• We may refuse, cancel, or limit quantities for any order (including for suspected fraud, pricing/availability errors, abuse, or regulatory restrictions).
• By placing an order, you authorize us (or our processor) to charge your selected payment method. Chargebacks filed without first providing us a reasonable opportunity to resolve an issue may be contested.

3) Pricing & Payment

Prices, promotions, and availability may change without notice. We may correct inaccuracies or errors (including after submission) by canceling and refunding. Sales tax may apply based on your jurisdiction.

If you have terms/PO arrangements, additional credit terms may apply as communicated to you in writing.

4) Shipping, Title & Risk

Unless otherwise stated in an order confirmation, title and risk of loss pass to you upon our tender of items to the carrier. Delivery dates are estimates and not guarantees. We may require signature on delivery at our discretion or at your request.

• Inspection on Delivery: Inspect all shipments upon receipt. Notify us and the carrier of damage or shortage within 5 business days.
• Delays: We are not liable for delays outside our reasonable control (including carrier issues or force majeure).
• Shipping Limitations: Certain addresses (e.g., PO Boxes/APO/FPO) or items may have restrictions.

5) Returns & RMAs

To start a return, email info@mjwoldow.com within 14 days of delivery to request an RMA. Items must be unused, in original packaging, and include all accessories.

Unless we made an error, return shipping is your responsibility and a restocking fee of up to 15% may apply to cover inspection and reconditioning.

6) Custom / Made-to-Order Work

• Custom orders may be non-cancelable and non-returnable once materials are cut or production begins.
• Reasonable manufacturing tolerances apply; samples/approvals govern if provided.
• You represent that any drawings, designs, or materials you supply do not infringe third-party rights; you grant us the necessary rights to use them to fulfill your order.

7) Permitted Use & No Medical Advice

You agree not to misuse the Site, interfere with its operation, circumvent security, or access data not intended for you. Automated scraping, bulk data extraction, or load testing requires our prior written consent.

No Medical Advice. Content on the Site is for general information only and is not a substitute for professional medical advice, diagnosis, or treatment. You are responsible for selecting and using products appropriately and in accordance with manufacturer instructions and applicable regulations.

8) Intellectual Property

All Site content is owned by MJ Woldow & Company, LLC or its licensors and protected by law. You may not reproduce, distribute, or create derivative works without permission, except as permitted by law (e.g., fair use).

9) Third-Party / Manufacturer Products

For products manufactured by third parties or sold as an authorized dealer, specifications, warranty, and after-sales support may be provided by the manufacturer. We may use manufacturer-supplied images and descriptions; minor variations may occur.

10) Tax-Exempt & Reseller Orders

Tax-exempt purchases require valid documentation before shipment. If documents are received after shipment, we may be unable to refund collected tax. We reserve the right to reject certificates we in good faith believe to be invalid or inapplicable.

11) Warranties & Disclaimers

EXCEPT AS PROHIBITED BY LAW OR AS EXPRESSLY STATED IN A WRITTEN WARRANTY PROVIDED WITH A PRODUCT, THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. FOR THIRD-PARTY/MANUFACTURER PRODUCTS, ANY WARRANTY IS PROVIDED BY THE MANUFACTURER AND NOT BY MJ WOLDOW & COMPANY, LLC.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MJ WOLDOW & COMPANY, LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THAT PRODUCT; FOR SITE/ACCOUNT CLAIMS, $100 IN THE AGGREGATE.

13) Export & Compliance

Products and content may be subject to U.S. export, sanctions, and other laws. You agree to comply with all applicable laws and not to export, re-export, or provide products to prohibited destinations or end users.

14) Governing Law & Disputes

These Terms are governed by the laws of the State of South Carolina, without regard to conflicts-of-law rules. Exclusive venue and jurisdiction lie in the state or federal courts located in Charleston County, South Carolina. You consent to personal jurisdiction in those courts.

15) Changes to Terms

We may update these Terms from time to time. The “Last updated” date reflects the most recent revision. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
